The KB Home Warranty |
At KB Home, we're committed to customer service, and our goal is to deliver homes that meet high quality standards. However, we recognize that a home consists of many systems and parts, and occasionally something in your home may not live up to those standards. In those cases we're committed to addressing concerns as quickly as possible.
When you sign your purchase agreement, you'll receive two warranty books the KB Home Limited Warranty and the Warranty Performance Standards (California homeowners receive the Homeowner Maintenance Guide rather than the Warranty Performance Standards.) We encourage you to read and familiarize yourself with these materials.
Of course, if you'd like to review the Warranty before signing your purchase agreement, your KB Home Sales Representative or Customer Service Representative will be happy to give you a copy.
It's likely that most issues that arise will be clearly described under the Warranty, and KB Home will make every effort to resolve these claims. However, if there's a Warranty claim that we can't resolve through the warranty claims process or negotiation, the Warranty requires the dispute to be arbitrated.
About Arbitration
"Arbitration" simply means a neutral third party will be brought in to help resolve the dispute. KB Home is responsible for paying all the fees and expenses of the organization to initiate and conduct the arbitration, including the arbitrator's compensation. You have no obligation to pay any of the arbitrator's fees or expenses; however, you are responsible for your own costs, such as the cost of hiring your own attorney or any specialists to help you in the arbitration.
If you are a KB Home Warranty holder with a warranty still in effect and would like another copy of the letter notifying warranty holders that KB Home will pay for the arbitration fees and expenses, click here.
Once the arbitrator has made a decision, KB Home will be bound by that arbitrator's decision if you choose, but you also have the right to reject this decision. This is referred to in your Warranty as "Non-Binding Arbitration." It's binding on KB Home (if you want it to be) but not on you. You must decide whether to accept or reject the arbitrator's decision after it's made. KB Home cannot reject the arbitrator's claim if you choose to accept it.
If you are a KB homeowner with a warranty that is still in effect and would like another copy of the letter notifying warranty holders that KB Home will no longer enforce the binding nature of the arbitration provision in your warranty with respect to any current or future disputes regarding your warranty claims, click here.
If you choose to reject the decision, you're free to file an action against KB Home in court. The timeframes for filing a lawsuit are specified in your Warranty. However, you are required to submit your claim to this arbitration process before filing any lawsuit.
